1. What SmartLPA is — and is not
SmartLPA is a document-preparation and checking tool. We help you prepare Lasting Power of Attorney (“LPA”) forms for England and Wales and run an automated check of your completed forms against the requirements of the Office of the Public Guardian (“OPG”).
SmartLPA is not a law firm and does not provide legal advice. Nothing in the Service is legal advice, and using the Service does not create a solicitor-client relationship. If you need legal advice about your circumstances, your attorneys, or the consequences of making an LPA, you should consult a qualified solicitor.
We do not register your LPA for you. You are responsible for signing your LPA in the correct order, having it witnessed correctly, and submitting it to the OPG for registration (the OPG charges its own separate registration fee, which is not part of our fee).
2. Eligibility
You must be 18 or over and able to enter into a binding contract to use the Service. The Service is intended for preparing LPAs under the law of England and Wales.
3. Your account
- You sign in using a passwordless “magic link” sent to your email. You are responsible for keeping access to your email account secure.
- You are responsible for the accuracy of the information you enter. Our check can only work with the information you provide.
- You must not misuse the Service, attempt to disrupt it, access it by automated means beyond normal use, or use it unlawfully.
4. The service we provide
Depending on what you purchase, the Service allows you to:
- Prepare one or more LPA forms (Property & Financial Affairs and/or Health & Welfare) through a guided process.
- Upload photographs of your completed, signed forms and receive an automated check against OPG requirements, highlighting potential issues.
- Download your prepared forms.
The check is a guide, not a guarantee. Our automated check is designed to catch common errors, but it cannot guarantee that your LPA will be accepted by the OPG. Acceptance depends on many factors, including correct signing, witnessing, and information you provide. You are responsible for reviewing your own forms and the check results before signing and submitting them.
Automated processing. The check uses artificial intelligence to read and assess your forms. See our Privacy Policy (section 5) for how your data — including health information in a Health & Welfare LPA — is processed by our AI provider.
5. Fees and payment
- Our current prices are shown on the Service before you pay. As at the date of these Terms: £59 for a single LPA, £99 for both LPA types for one person, and £169 for a couples bundle (both types for two people). Prices may change from time to time; the price shown at checkout applies to your purchase.
- The OPG registration fee is separate and is paid by you directly to the OPG. It is not included in our fee and is not paid to us.
- Payment is processed securely by Stripe. We do not store your full card details.
- Our fees are for the digital service (preparing and checking your forms). A printed-and-posted option is not currently offered.
6. Refunds and cancellation
- Digital service / right to cancel. Because the Service is the supply of digital content and services that begins as soon as you start using it, where you ask us to begin immediately and you acknowledge that you will lose your statutory 14-day right to cancel once the service has been fully performed, that right may not apply. Your statutory rights as a consumer are not otherwise affected.
- If something goes wrong on our side — for example, the Service fails to deliver the check you paid for — contact us and we will put it right or provide a refund as appropriate.
- We may issue refunds at our discretion where we consider it fair to do so.

Nothing in this section removes or limits your rights under the Consumer Rights Act 2015 or other consumer-protection law.
7. Your responsibilities
You are responsible for:
- The accuracy and completeness of the information you provide.
- Reviewing your prepared forms and the check results before you rely on them.
- Signing and witnessing your LPA correctly, in the right order.
- Submitting your LPA to the OPG and paying the OPG’s registration fee.
- Ensuring an LPA is appropriate for your circumstances (if in doubt, seek legal advice).
8. Intellectual property
The Service, including its software, design, text, and branding, is owned by SmartLPA Ltd and protected by intellectual-property law. We grant you a limited, personal, non-transferable licence to use the Service to prepare and check your own LPAs. The content you enter and the completed forms you produce are yours.
9. Availability
We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may suspend or withdraw parts of the Service for maintenance, updates, or reasons beyond our control.
10. Our liability
- We provide the Service with reasonable care and skill. However, because SmartLPA is a preparation and checking tool and not a substitute for legal advice, we are not responsible for decisions you make about your LPA, for errors in the information you provide, or for the OPG’s decision to accept or reject your application.
- Our check does not guarantee acceptance by the OPG (see section 4).
- We do not exclude or limit our liability where it would be unlawful to do so — including for death or personal injury caused by our negligence, or for fraud.
- Subject to that, and to the fullest extent permitted by law, our total liability to you arising out of or in connection with the Service is limited to the amount you paid us for the relevant purchase.
- We are not liable for indirect or consequential losses, or for loss arising from your failure to review your forms, sign or witness them correctly, or submit them properly.
11. Ending your use of the Service
You can stop using the Service and delete your account at any time from your account settings. We may suspend or end your access if you breach these Terms or misuse the Service.
12. Changes to these Terms
We may update these Terms from time to time. The version in force is the one published on the Service, with the “Last updated” date shown above. Significant changes will be brought to your attention where reasonably practicable.
13. Governing law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, subject to any consumer-protection rights you have to bring proceedings in your local courts.
